Terms of Service for Entitled Stories

Welcome to Entitled Stories (“the Website”), located at entitledstories.com. By accessing or using the Website, you agree to be bound by these Terms of Service. If you do not agree, please do not use the Website.

1. Submission of Content

By submitting a story, anecdote, or any other content (collectively, “Submissions”) to Entitled Stories, you agree to the following:

  • Originality Warranty: You represent and warrant that the Submission is your own original work, that you own all rights to the content, and that it does not infringe upon the intellectual property or privacy rights of any third party.
  • License Grant: You hereby grant Entitled Stories a non-exclusive, royalty-free, worldwide, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, and display the Submission in connection with the Website and its successors’ business, in any media formats and through any media channels, in perpetuity.
  • User Indemnification: You agree to indemnify, defend, and hold harmless Entitled Stories, its owner, and its affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from your Submissions or your violation of these Terms. Entitled Stories provides no indemnification to you for any reason.

2. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF ENTITLED STORIES, ITS OWNERS, AND OPERATORS FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE USE OF THE WEBSITE SHALL BE LIMITED TO ACTUAL DAMAGES PROVEN BY THE USER OR ONE HUNDRED DOLLARS ($100.00 USD), WHICHEVER IS LESS. IN NO EVENT SHALL ENTITLED STORIES BE LIABLE FOR ANY INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

3. CLASS ACTION WAIVER

YOU AND ENTITLED STORIES AGREE THAT ANY PROCEEDINGS TO RESOLVE OR LITIGATE ANY DISPUTE WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS. NEITHER YOU NOR ENTITLED STORIES WILL SEEK TO HAVE ANY DISPUTE HEARD AS A CLASS ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR IN ANY OTHER PROCEEDING IN WHICH EITHER PARTY ACTS OR PROPOSES TO ACT IN A REPRESENTATIVE CAPACITY.

4. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles.

  • Venue: You expressly agree that any legal action, suit, or proceeding arising out of or relating to these Terms or your use of the Website shall be instituted exclusively in the state or federal courts located in Kane County, Illinois. You hereby consent to the personal jurisdiction of such courts.

5. User Conduct

You agree to use the Website only for lawful purposes. You are prohibited from submitting content that is defamatory, obscene, or intended to harass individuals. Entitled Stories reserves the right, but not the obligation, to remove any Submission at its sole discretion.

6. Disclaimer of Warranties

The Website is provided on an “as-is” and “as-available” basis. Entitled Stories makes no representations or warranties of any kind, express or implied, regarding the accuracy or reliability of the stories archived on the site.

7. Changes to Terms

We reserve the right to modify these terms at any time. Your continued use of the Website following the posting of changes constitutes your acceptance of such changes.
